Kampala, Uganda | THE INDEPENDENT | The Civil Division of the High Court in Kampala has instructed the Uganda Law Society to adhere to their Election Regulations of 2016 when selecting representatives for boards, committees, or commissions of its various statutory bodies.
This directive comes in response to a case brought forward by Steven Kalali, a member, who challenged the society’s retention of certain representatives, alleging a violation of the Uganda Law Society Act and Election Regulations of 2016.
In the ruling delivered by Justice Boniface Wamala, it was acknowledged that the Uganda Law Society has consistently violated the Election Regulations of 2016, without specifically attributing this to the current leadership under President Bernard Oundo.
“I have observed a breach of provisions of the ULS Act and Election Regulations. The only order available to the applicant, and which I accordingly issue, is an order of a permanent injunction restraining the respondent’s counsel from any further breach of the act and the Election Regulations regarding the election of the society representatives,” declared Justice Boniface Wamala.
Furthermore, the Court has emphasized the importance of treating elective positions as genuinely elective, serving as a reminder to the law society to uphold the principles of their internal democratic processes.
