UGANDA: #SocialMediaTax; is Uganda a reseller of what they are taxing?
Ugandans were circulating fake news today that Facebook Inc. has launched a lawsuit against the Uganda govt for Patent Infringement.
Three things to note:
1) If the suit was real, global media would have run the story. None has done it so far.
2) Taxing those Apps is not Patent Infringement. I will explain Patent Infringement another day.
3) Uganda is acting like a Reseller. One can resell Apps and software under license.
When my company Nangalama Enterprises Inc. used to be a Microsoft Partner, we were resellers. We paid an annual fee. We would then get 40 site licenses to install all Microsoft tools at 40 sites. We would charge the clients any amount we wanted.
The Microsoft Patternership gave us a key for each piece of software to use for each client.
So none of our clients were using pirated software. We would charge all required fees plus our consulting fee and maintenance fee.
So Uganda has every right to charge if they are a paid reseller.
Consequently, this then means the govt is reselling what they have not paid for. It is theft. Like plagiarism.
They should review the legalities around selling software you are not licensed to sell.
